Texas ranks highest in number of workplace discrimination complaints

Last year, the Equal Employment Opportunity Commission received more complaints from the state of Texas than any other state in the nation, according to a recently released report.

During the fiscal year there were nearly 10,000 complaints made the EEOC from the state of Texas out of the total of 99,947 nationwide. Out of the complaints filed in the state, the most common claims stated that employees were retaliated against after they fought discrimination in some form or another.

The second and third most common reasons were gender and race discrimination. Attorneys have stated that Texas may have more complaints because the large population of Texas residents compared to other states.


Man claims sexual harassment from female officer caused him to lose job

A Galveston man has claimed that he was the victim of sexual harassment from a female corrections officer.

According to the lawsuit that was filed in a Galveston County court earlier this month, the man stated that the female officer subjected him to unwanted sexual advances from May 2011 to October 2011.

The suit stated that the man lost his job because he showed “resistance to the misconduct.” The lawsuit names 11 incidents where the officer allegedly tried to seduce the man. The lawsuit states that many of the sexual advances occurred in public or in front of other co-workers.

He also stated that he was retaliated against because he denied the advances.  The man tried to collect evidence of the harassment by using a recording device and shortly after this, he was told that he was suspended until later notice. This complaint led to his resignation in November 2011.

Dallas hospital being investigated for alleged retaliation

Regulators are currently investigating a retaliation case after a Dallas hospital allegedly fired a social worker when she filed a complaint against her supervisors when they asked her to violate regulations.

According to the Department of State Health Services, a lawsuit has now been filed against the Parkland Memorial Hospital after a former social worker was fired for stating that her supervisors asked her to transcribe the vouchers for medication, talk about medications with patients and also discuss different “medication options with doctors.”

Social workers should make recommendation for medication prescriptions or transcribe vouchers. The lawsuit claims that the woman was fired shortly after reporting this issue. This is not the first incident that has come about at the hospital and regulators are now stating the the hospital needs a complete overhaul.

Man files unpaid overtime lawsuit in Sherman

A former employee at Viva Railings has filed a lawsuit against the company that states that they failed to pay overtime when they required employees to work over 40 hours.

According to the lawsuit, the man worked for Viva Railings from April 23, 2010 to November 22, 2011 and stated that for 39 weeks, he was not paid overtime even though he averaged 56 hours a week.

The man is now seeking the compensation from missed wages, the company has already paid the partial amount of overtime at this time. He is also seeking wages for physical pain, mental anguish, liquidated distress and punitive damages.

Nicollette Sheridan receives re-trial for wrongful termination lawsuit

A wrongful termination lawsuit filed by Desperate Housewives actress, Nicollette Sheridan, has now received a re-trial date.

According to court documents, the lawsuit claims that Sheridan’s character on the television show was “killed off” because of a fight that she got into with the show’s creator, Mark Cherry.

Study: Sexual harassment lawsuit filers more likely to leave before alleged offender

A recent study done at the Centre for Work and Life at the University of South Australia stated that when it comes to sexual harassment lawsuits, the person who has filed the lawsuit is more likely to leave the company before the alleged offender does.

The study found that 60 percent of lawsuit complainant’s will resign or quit their job compared to 10 percent of the accused perpetrators.

Employee files racial discrimination lawsuits against BASF

A former employee at a Beaumont BASF facility has now filed a racial discrimination lawsuit against supervisors for allegedly failing to respond to claims of a hostile work environment.

According to court documents, the lawsuit was filed last week against the BASF Corp. and states that the former employee was discriminated against and denied opportunities because of his race.

The lawsuit claims that black employees were taunted with nooses and a written policy prohibiting this had to be written up. Employee files gender discrimination lawsuit against Sonic

An employee at the fast food chain, Sonic, has filed a gender and racial discrimination lawsuit against employers after co-workers allegedly made racial slurs as well as sexually inappropriate comments.

According to the lawsuit that was filed on March 30, the black female filed the lawsuit stating that co-workers showed her inappropriate pictures and made ‘physical sexual simulations’  toward her.

The woman claimed that she made repeated complaints about the issue and management did not do anything to address the concerns.  The lawsuit then states that the woman filed a complaint with the general manager and said that she would file a lawsuit with the Equal Employment Opportunity Council. She was then fired a short time later.

Brownsville high school coach files racial discrimination lawsuit

A former coach at Porter High School in Brownsville has now filed a racial discrimination lawsuit against the independent school district claiming that he after he was fired for an incident in 1995, he has been unable to get a knew job in the district because of his race.

The man was fired in 1995 after showing students a “graphic sex guide” and this caused an uproar that led to him losing his job. He was cleared to teach again after the incident, but he was not given his job back.

He then applied to teach at the Faulk Middle School, but the job was given to a former city commissioner who only was obtaining an alternative teaching certification at the time. The former coach stated that he was skipped over because of his race.

Lovejoy High School coach files discrimination lawsuit

A former basketball coach for Lovejoy High School has now filed a lawsuit against the school district claiming that she was treated differently at work because of her age, race and gender.

The coach stated that she was subjected to comments about her race and was also told to favor the white players. According to the lawsuit, the coach’s job was threatened whenever she objected these requests.

She filed a formal complaint with the Equal Employment Opportunity Commission and stated that after this was done, she was reassigned to a different teaching position in retaliation. While coaching, her team made it to the State Finals, but she did receive low scores on her performance review.
